
Police: 9-Year-Old Shot at a Gas Station in Upstate New York
Police in Upstate New York say an altercation between an unruly customer and a gas station employee escalated into gunfire, and an innocent bystander, a 9-year-old boy, was struck in the upper chest.
Altercation Turns into Gunfire
Police in Henrietta, New York, say that the incident happened after 11:30 a.m. on Saturday.
That's when, according to the report, 911 dispatchers received a call about a physical altercation between an unruly individual and a gas station employee at the Speedy Trac gas station and convenience store, located at 4011 W. Henrietta Road, Henrietta.

Accordng to deputies, the altercation escalated between the suspect and the store owner, and that's when the suspect drew a revolver and fired two rounds inside the store.

Young Boy Shot; Currently in Stable Condition
Police say that a nine-year-old boy, who was waiting with his father to cash out, was shot once in the upper chest. Thankfully, the store owner, along with other employees and customers, was able to disarm and subdue the shooter.
According to the report, when deputies arrived, the child was transported immediately to a local hospital for treatment of his injuries. As of late Saturday afternoon, deputies reported that the boy was in stable condition and expected to make a full recovery.
Charged: 35-Year-Old with Multiple Arrests
Deputies also recovered the revolver and detained the suspect, Ruben Smith, 35, of Henrietta. Smith was arrested and charged with the following:
- 2 counts of Assault in the 2nd degree (Class-D Felony
- 2 counts of Criminal Possession of a Weapon in the 2nd degree (Class-C Felony)
Deputies say that Smith is a "predicate felon known to law enforcement, with multiple prior arrests," and he did sustain minor injuries during the incident, was transported to a local hospital, treated, and released.
