
New Bill Would Change Where New Yorkers Vape, Smoke Weed
New Bill is Designed to Protect Children
If you vape or smoke cannabis, a newly proposed bill - designed to protect children - would put additional restrictions on New York residents.
According to a report from WGRZ, the new bill proposed this week in Albany would restrict adults from smoking or vaping cannabis near children or specific places where children might be.
30 Feet Away from Kids
According to the report, adults would no longer be able to smoke or vape weed "within thirty feet of a child or within thirty feet of any location in which children reside or attend for any recreational or educational purpose, including areas separated by walls, closed doors or floors within a building."
"I've heard from a number of individuals regarding concerns of the use of cannabis around children, as well as our hospital facilities where children have been brought to the ER as they have been exposed to cannabis," said Assemblywoman Marianne Buttenschon said, WGRZ.com
Can It Be Properly Enforced?
Lawmakers will take a wait-and-see approach, but some officials think the new bill wastes time.
Attorney Barry Covert told WGRZ that this would be very hard to enforce, considering that it's nearly impossible to know where kids are at all times.
Covert explained, "What if you're in a condo and you have a neighbor who has children? What if you have children that ride by you on a bicycle or jog by you? Are you going to walk around with a tape measure to see what thirty feet is?"
What's the Proposed Punishment
According to data, 12.6% of New York State adults report consuming cannabis in the past 30 days, meaning that roughly 2.4 million New Yorkers could be affected by this new bill.
According to the report, the bill would also include a new punishment saying you'd be charged with a class B misdemeanor if it's your second violation. That could be up to 90 days in jail.
As of now, for any violation, you're fined up to 25 dollars or assigned up to 20 hours of community service.
