The parents of a Niskayuna High School female student are suing the district because they say the district failed to protect their daughter and didn't follow the school's code of conduct.

According to the suit, the victim, a high school girl, had been dropped off for a final exam, but with no designated area for students to wait, she and the suspected student entered an empty classroom. Once inside the room, the male student allegedly pulled down her pants, put his hand up her shirt, exposed himself and tried to make her perform a sex act.

The suit references a prior incident where the same boy assaulted a different girl off campus the year before. The parents of the girl who was allegedly assaulted in the classroom are upset because they say the administration knew the boy was dangerous and did nothing to prevent him from assaulting another girl.

Both allegedly known assaults happened within a four-month period in 2015.

The male student accused in the assault was charged in juvenile court with forcible touching.

According to this article, the Niskayuna School District says they are aware of the lawsuit but it's their policy not to comment on it.
