New York Resident Embroiled in Wrongful Death Lawsuit with Disney World
A legal battle is raging on between a New York man and the Walt Disney Corporation.
The man, Jeffrey Piccolo of Rocky Point, NY, has filed a wrongful death lawsuit against Disney. Tragically, Piccolo lost his wife, Dr. Kanokporn Tangsuan, in 2023 while at Disney World in Florida.
Tangsuan, a physician at NYU Langone Hospital, suffered a fatal allergic reaction while eating at a Disney Springs restaurant, according to People Magazine. Piccolo's lawsuit alleges that Tangsuan informed the wait staff about allergies to dairy and nuts, yet was still served food containing both.
Piccolo wrote on his Facebook page that [t]en minutes before she passed she was perfectly healthy and enjoying herself shopping and then minutes later she died. The incident occurred on October 5, 2023.
Disney, however, is attempting to get this case thrown out of court. According to court records, Piccolo signed up for a one-month trial of Disney+ back in 2019, and the terms and conditions require members to arbitrate all disputes with the company.

The terms attached to his Disney+ trial, as well as his 2023 purchase of theme park tickets, are written in a way that exonerate the company from any wrongdoing.
Piccolo's lawyers described Disney's filing for dismissal as preposterous and fatally flawed. On the topic of the terms and conditions being enforceable, Piccolo's representatives said it is outrageously unreasonable and unfair as to shock the judicial conscience.
